This page represents our Terms of Use ("Terms") regarding our Platform. We may amend these Terms at any time by posting the amended terms on the Platform. We may or may not post notices or give notifications on the Platform when such changes occur. We refer to these Terms, our Privacy Policy (as provided hereinafter) and the Terms and Conditions for Customers accessible at Terms&Conditions and any other terms, rules, or guidelines on our Platform collectively as our "Legal Terms." The terms, "You" and "Your" "Customer" as used in these Terms refer to the user who accesses the Platform through the Mobile App. You explicitly and implicitly agree to be bound by our Legal Terms each time you access our Platform. If you do not wish to be so bound, please do not use or access our Platform.
1.1. "Company" means Ashok Leyland Ltd, having its registered office at No-1, Sardar Patel Road, Guindy, Chennai - 600032. (Hereinafter called "ALL" or "Company", which expression includes its successors and assigns).
1.2 "USER" shall mean any individual person, company, proprietorship or partnership firm or any other association of persons or entity of whatever nature, who/which has registered for the services and include User's heirs, executors, administrators, successors and permitted assigns. The term USER includes executives and employees of ALL, technicians of ALL channel partners (permanent or on contract) including any other authorised personal registered by ALL Channel partner in our DBM system and any other trained mechanics or electrician whom are pre-registered by ALL executives through the application, may or may not be associated with purchasers or operator of ALL vehicles as the context requires.
1.3. "Intellectual Property" means and includes all copyright, patents, database rights and rights in trademarks, designs, know-how and confidential information (whether registered or unregistered); and all other intellectual property rights and equivalent pertaining to the web Services, Mobile Application (as the case may be) including the data generated on the web or Mobile Application, online portal (by whatever name called) and also the rights pertaining to hosting or making the Mobile Application, Services available on any app store, device or server.
1.4. "Mobile Application" shall mean the various mobile application owned by the Company and hosted as a part of the E&E Diagnosis App platform from time to time.
1.5. "Network" shall mean telecommunication network through which services are made available.
1.6. "Service(s)" shall mean diagnostics related services , which may be offered by the Company. Services include the various monitoring of vehicle data, adjustment of various vehicle parameters, guided diagnostic and other features offered by ALL through mobile application.
2.1 Services shall be available at all times subject to Force Majeure conditions including but not limited to act of God, fires, strikes, embargoes, war, insurrection, riots and other causes beyond the reasonable control of the Company including atmospheric / geographical hindrances.
2.2 Company may temporarily suspend whole or part of the Services at any time without notice, if the infrastructure or telecommunication network fails or requires modifications or maintenance.
2.3 These terms and conditions shall become effective upon ALL, at its sole discretion, accepting the new users, and shall continue to remain in force until terminated.
2.4 The Company reserves the right to reject any request / application for any reason without any liability. The information provided by the users/ gathered by ALL shall become the ALL's property .
2.5. Company provides access to the users based on the mobile number registered with ALL. The use can reset the password based on OTP received on the registered mobile number. It shall be the responsibility of the user not to divulge the login information to any third party. In the event the user shares or authorizes any third party to the use mobile application and its Services, it will be the sole responsibility of the user and for any unauthorized usage the Company shall not be liable for any consequences of whatsoever nature.
2.6 In case the company receives information about unauthorised use or misuse of the mobile application, the company reserve the right to terminate the access to user immediately without any prior notice.
2.6. The Company reserves its right to further develop the Services or features of the web / mobile Application without any notice or any obligation to the User, ALL shall be the sole and absolute legal owner of any future development of the Web / Mobile Application or any feature to the same.
3.1. It shall be the obligation of the user to install the relevant Mobile Application on his mobile from online mobile application store. The owner / driver shall ensure that the mobile equipment used shall have minimum feature to download and access the mobile application.
3.2. User understands the same and unequivocally agrees that the Services shall be available only if the mobile has these minimum features. Minimum features required for usage of Mobile Application shall be updated from time to time and it shall be the obligation of the user to accordingly upgrade their mobile devices at their own costs and expenses.
4.3. For installing the Mobile Application in the mobile device a onetime password (OTP) will be generated, the user expressly agrees not to share the OTP to any person and the Company shall not be responsible for any consequences arising due to sharing of such OTP's.
4.1. The user hereby provides express and unlimited consent to use the data which has been udpated using the mobile application(s), website(s) and server of the Company towards providing the Services. The data for which express consent is provided by the owner of vehicle, fleet manager and driver.
4.2. The data which may be derived shall include the users Name, image, mobile number, and other related details as uploaded in the mobile by the user.
4.3. The user hereby authorise the Company to share / use the vehicle related performance and behavior details , all technical details of the vehicle and other related details of the vehicle.
4.4. By providing the vehicle related data / vehicle performance related information, ALL shall not be liable to the user in any manner whatsoever nature to the any user.
5.5. The USER hereby expressly authorise AL to use the data, information which are extracted and provided through this Mobile Application to commercially monetize the same at present and in the future by creating any digital platforms or through any other mode. Further, the data and information which are provided may be shared with third parties for any purpose of whatsoever nature. The user shall have no claim either monetary or otherwise against ALL, its subsidiaries, its directors or any of its employees.
5.1. User hereby expressly consents that the Data which is provided for providing the Services will be shared by ALL if the same is requested or required pursuant to legal process or is required to be disclosed by law, or regulation, Warrants or court order.
5.2. The User expressly consents and permits that the Data which are provided by the user shall be shared with law enforcement agencies (including police) as required by them.
6.1. The Company shall be responsible for providing the services to the User Registered with the company
6.2. Ashok Leyland shall take necessary precautions to notify the user in case of a scheduled shut down of services. However, in case of an unforeseen shut down without notice to the Users due to IT infrastructure failure or due to Internet Link failures or shutdown owing to statutory regulations or natural calamities, ALL shall not be liable fin any form to the User for any Data Loss or any consequential losses.
6.3. The Company shall not be responsible for any act of commission or omission of any third party / supplier / manufacturer / agency / Company offering any privilege or benefit to the User without express permission or authority of the Company.
6.4. The data collected by app services through the mobile applications from the vehicles shall be used by Ashok Leyland, its Dealer network, service providers and affiliates to provide need-based services to the user
6.5. The company hereby makes it explicit that it does not guarantee 100% availability of the service all the time.
6.6. Company and its authorized network will have the access rights to get information / data on locations of user at the time of usage and will have access to the vital information for the purpose of prognostics / diagnostics in order to support the customer in faster response and restoration of the vehicle. The User acknowledges this feature and gives consent for usage of the data for the above purposes.
6.7. The services comprise of remote diagnostics, vehicle performance and other features and reports are provided in order to understand and assist user in improving the vehicle performance.
6.8. Company is entitled after prior intimation and confirmation change, vary, add, withdraw any service and /or change, vary, add, alter, delete, withdraw any/all charges, discounts, due dates, surcharge, tariff, etc., at any point in its sole discretion for one or more or all of its Users except in the case of discounts or other special benefits or scheme/plans announced by the Company from time to time and which are valid for specified periods.
6.9. The Company shall reserve the right to transfer or assign and / or delegate all or part(s) of its obligations, rights and /or duties under these terms and conditions to any party. Such transfer / assignment shall release the Company from all liabilities under these terms and conditions.
6.10. The Company may be required to disclose any information or particulars pertaining to the Users to any Authority, statutory or otherwise, including but not limited to, any security agencies and reserves the right to comply with the directions of such authorities at its discretion and without intimating the User.
6.11. The Company reserves the right to seek / verify particulars provided by the User to the Company, in any manner without notice or intimation.
6.12. The Company reserves the right to provide services through its agents and franchisees.
6.13. The Company shall unless the User indicates otherwise send promotional material to User via secured electronic media, which or otherwise include text messages, multimedia content, pictures, emails and voice.
6.14. The Company reserves the right to access anytime any/all the vehicle and user related data stored in the application memory, anywhere in the network or in its infrastructure.
6.15. The Company assumes no responsibility for user's improper storage of data or information or delivery of messages.
7.1. User is not entitled to transfer or assign its obligations and liabilities under the terms and conditions to any other party under any circumstances without prior permission of the Company. Any transfer affected in contravention of the express terms contained herein shall not absolve the User of his obligations/liabilities towards the Company for charges levied against the User.
7.2. User assumes the entire risk in downloading or otherwise accessing any data, information, files or other materials obtained from the Ashok Leyland and shall pay telecommunication charges directly to their respective telecommunication service providers.
7.3. User acknowledges that use of the Service may have user data privacy implications.
7.4. Whether, and to what extent, an user's privacy rights are implicated may be affected by such things as: the use to which the Service is put; the information that is gathered by the Service; the dissemination of information that is gathered; the actions that are taken based upon the information gathered; the Owner of the vehicle's knowledge and/or consent to such monitoring; the policies and procedures that have been implemented and communicated by the administrator; and current central and state laws, regulations and constitutional rights applicable to the user
7.5. The user acknowledges that the company has the right to have internal access to and track services used by the user including the location in which it was used User
7.6. The User agrees to provide necessary permissions & consent to share all the above data for the above purposes
7.7. User shall not use the service for any improper, immoral, unlawful or abusive purpose or for sending obscene, indecent, threatening, harassing, and unsolicited messages to create any damage to the Company or any other person whomsoever. Any such misuse shall under no circumstance be attributed to the Company and the User shall be solely responsible for such acts. User hereby agrees to indemnify and hold harmless the Company and its agent and franchisees from all suits, proceedings, costs, damages or claims of any kind arising out of any act or omission or misuse of the service by the User or any other person with or without the consent of the User.
7.8. In the event of there being any deficiency in the services, the User shall intimate within a period of seven (7) days of the occurrence of the deficiency to the Company and there upon the Company shall endeavor to rectify the same within a reasonable period. 8.1. Service quality functionality availability and/or reliability may be affected and/or the Company is entitled to, without any liability to refuse, limit, suspend, vary, disconnect and/or interrupt the services in whole or in part, at any time in its sole discretion with respect to one/all Users without any notice for any reason and/or due to various factors including but not limited to:
8.1.1. Changes in the law, rules, regulations of order, directions, notifications etc. by the authorities.
8.1.2. Transmission limitation caused by physical obstruction, geographic, topography, hydrological, metrological and other causes of radio interference or faults or disruption in telecommunication service provider to which ALL network is connected.
8.1.3. Force Majeure circumstance.
8.1.4. Any discrepancies / wrong (s) provided by the User.
8.1.5. In case of misuse of services or breach of any terms and conditions by the User or use of services in such manner that it violates any laws or adversely affects or interferes with the Company service, Company shall give notice of five (5) days to the User to remedy the breach. In case the User fails to remedy the breach within the notice period, the Company is entitled to disconnect the services without any further notice.
8.1.6. In other case the Company at its sole discretion may suspend / discontinue the services by giving reasonable notice to User in such form as may be decided by the Company.
User hereby agrees
9.1. The User shall not directly or indirectly disclose or otherwise provide any Confidential Information relating or sublet or issue of the Services to any third party and such permission shall result in termination of the Services without notice.
9.2. Ashok Leyland shall not be responsible for any unauthorized use of the mobile app Services or misuse of password and any consequential loss of data or damages. The User shall be solely responsible for the safe use of the mobile app service.. The User agrees that it shall not share the password with any person and shall be responsible for all consequences which may arise for sharing or leaking the password.
9.3. Only User's authorized personnel shall be permitted to access the services through mobile phones Any attempt to access the services by any/all personnel other than the authorized personnel of the User will deemed to breach of the agreement and liable to legal proceedings.
10.1. Other than specifically provided in these terms, no right or license is granted to the User under any Intellectual Property of the Service, trademarks, Mobile Application, including any patent or patent application and no other right or license to use Confidential Information is granted hereby. The Service provided by the Company to the Customer shall in no manner be construed, in any way to confer/grant/license any right over any Intellectual Property of the Services or Mobile Application.
10.2 . All content or data in the Mobile Application, including but not limited to the text, music, sound, photograph, videos, graphics and images are governed and protected by the Indian Copyright Act, 1957 and subsequent amendments, the Trademark Act, 1999 and the subsequent amendments, and other all laws relating to Intellectual Property.
10.3. None of the content on the Mobile Application be downloaded, copied, reproduced, republished, posted, transmitted, stored, sold or distributed without the prior written permission of the Company.
10.4. The Customer shall not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify such Intellectual Property of the Company in any way, including in advertising or publicity or on any other website or network computer environment, without the express prior written consent of the Company. .
11.1. The validity, construction and performance of terms and conditions herein shall be governed and interpreted in accordance with the laws of India and the Company and User agree to submit to the exclusive jurisdiction of the Chennai courts.
11.2 . Should any provision of therein be or become ineffective or beheld to be invalid, this shall not affect the validity of the remaining provision hereof.
11.3. Unless or otherwise expressly stated, the terms defined in the terms and conditions, include the plural as well as the singular, masculine as well as feminine and natural person is deemed to include any Company, partnership, joint venture, association, corporation or any other body of government agency.
11.4. In case two or more persons constitute the User, their liability shall be joint and several.
11.5 . These terms and conditions are subject to the Information Technology Act, 2000 and Indian Telegraph Act of 1885, Indian Telegraph Rules and regulations framed there under and any statutory amendments/modifications or reenactment for the time being in force and also subject to the statute, rules and regulations and guidelines as may be enforced from time to time.
11.6. Unless / otherwise specially provided by the Company, no delay or failure to provide services or to exercise any of his rights shall impair such rights or shall be construed to be a waiver by the Company.
I wish to confirm / declare / undertake as under:
12.1. I have read and understood the details / terms and conditions of ALL Services and agreed to abide / bound by the same.
12.2 I further declare that the particulars stated by me during registeration are true and correct. In case of any of them are found to be false and incorrect, ALL has the right to suspend / disconnect the Services. I will be liable to return the vehicle mounted unit and pay to ALL as per the terms and conditions.
12.3 . I agree to provide necessary permissions & consent to share all the data generated from the Mobile app to ALL and its authorized network for its internal use as defined in the terms and conditions.
12.4. I further declare that I have understood and willfully chosen the telecom tariff plans and agree to be bound and pay monthly charges towards the services as per plan. ALL will not be responsible for rate of the data consumption and data consumed as a result of using the service via the mobile application.
12.5. I undertake that the Services will be used by me and I will not sublet or issue to any third party without permission of ALL.
The Platform Provider grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Platform for you to use the services listed on our Platform across India for servicing and repairs of legally purchased AL vehicles and other related services through our Platform, strictly in accordance with our Legal Terms.
Unless otherwise noted, all materials including without limitation, logos, brand names, images, designs, photographs, video clips and written and other materials that appear as part of our Platform are copyrights, trademarks, service marks, trade dress and/or other intellectual property whether registered or unregistered ("Intellectual Property") owned, controlled or licensed by the Platform Provider. Nothing on our Platform should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Intellectual Property displayed or used on our Platform, without the prior written permission of the Intellectual Property owner. The Platform Provider aggressively enforces its intellectual property rights to the fullest extent possible under the law. The names and logos of the Platform Provider, may not be used in any way, including in advertising or publicity pertaining to distribution of materials or provision of any services on our Platform, without prior, written permission from the Platform Provider. The Platform Provider prohibits use of any logo of the Platform Provider or any of its Affiliates as part of a link to or from any Platform unless the Platform Provider approves such link in advance and in writing. Fair use of the Platform Provider's Intellectual Property requires proper acknowledgment. Other product and company names mentioned on our Platform may be the Intellectual Property of their respective owners.
Our Platform may contain links to websites owned or operated by parties other than the Platform Provider. Such links are provided for your reference only. The Platform Provider does not monitor or control outside websites and is not responsible for their content. The Platform Provider's inclusion of links to an outside website does not imply any endorsement of the material by our Platform or, unless expressly disclosed otherwise, any sponsorship, affiliation or association with its owner, operator or sponsor, nor does the Platform Provider's inclusion of the links imply that the Platform Provider is authorized to use any trade name, trademark, logo, legal or official seal, or copyrighted symbol that may be reflected in the linked website.
The Platform Provider is entitled to post on our Platform at such times as the Platform Provider determines in its discretion. You should not assume that the information contained on our Platform has been updated or otherwise contains current information. The Platform Provider does not review past postings to determine whether they remain accurate and information contained in such postings may have been superseded.
THE INFORMATION AND MATERIALS IN OUR WEBSITE AND OUR MOBILE APP ARE PROVIDED FOR YOUR REVIEW IN ACCORDANCE WITH THE NOTICES, TERMS AND CONDITIONS SET FORTH HEREIN. THESE MATERIALS ARE NOT GUARANTEED OR REPRESENTED TO BE COMPLETE, CORRECT OR UP TO DATE. THESE MATERIALS MAY BE CHANGED FROM TIME TO TIME WITHOUT NOTICE.
You understand that we offer the repair services for legally purchased AL vehicles across India for the purpose of servicing and repairing commercial vehicles through our Platform. You will at all times look to any authorised dealer and/or authorised service centre that you select for vehicle repair services/spare parts supply as to any deficiency, queries, claims, losses, etc. related to such services.
OUR MOBILE APP IS OPERATED BY ASHOK LEYLAND LIMITED ON AN "AS IS," "AS AVAILABLE" BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM PROVIDER SPECIFICALLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT FOR OUR MOBILE APP AND ANY PRODUCTS AND SERVICES YOU PURCHASE THROUGH IT. THE PLATFORM PROVIDER SHALL NOT HAVE ANY LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF OUR MOBILE APP, FOR PRODUCTS OR SERVICES SOLD/PROVIDED THROUGH OUR MOBILE APP, FOR YOUR ACTION OR INACTION IN CONNECTION WITH OUR MOBILE APP OR FOR ANY DAMAGE TO YOUR COMPUTER OR DATA OR ANY OTHER DAMAGE YOU MAY INCUR IN CONNECTION WITH OUR MOBILE APP. YOUR USE OF OUR MOBILE APP AND ANY PARTS, PRODUCTS, COMPONENTS PURCHASED OR SERVICES AVAILED ARE AT YOUR OWN RISK. IN NO EVENT SHALL EITHER THE PLATFORM PROVIDER BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OUR MOBILE APP, ANY PARTS, PRODUCTS, COMPONENTS PURCHASED OR SERVICES AVAILED OR PURCHASED THROUGH OUR MOBILE APP, THE DELAY OR INABILITY TO USE OUR MOBILE APP OR OTHERWISE ARISING IN CONNECTION WITH OUR MOBILE APP, ANY PARTS, PRODUCTS, COMPONENTS PURCHASED OR SERVICES AVAILED, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. IN NO EVENT SHALL THE PLATFORM PROVIDER BE LIABLE FOR ANY CLAIM OR LOSS FOR THE TRANSACTION GIVING RISE TO SUCH CLAIM OR LOSS.
WITHOUT LIMITING THE FOREGOING, THE PLATFORM PROVIDER DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ON THE MOBILE APP IS ACCURATE, COMPLETE, RELIABLE, USEFUL, TIMELY OR CURRENT OR THAT OUR MOBILE APP WILL OPERATE WITHOUT INTERRUPTION OR ERROR.
YOU AGREE THAT AT ALL TIMES, YOU WILL LOOK TO THE MECHANICS, SPARE PARTS RETAILERS, DEALERS AND/OR MANUFACTURERS FROM WHOM YOU PURCHASE/AVAIL ANY GOODS AND/OR SERVICES FOR ANY CLAIMS OF ANY NATURE, INCLUDING LOSS, DAMAGE, OR WARRANTY. THE PLATFORM PROVIDER AND THEIR RESPECTIVE AFFILIATES MAKE NO REPRESENTATION OR WARRANTIES ABOUT ANY PRODUCTS, PARTS, COMPONENTS AND/OR SERVICES OFFERED THROUGH OUR MOBILE APP.
THE PLATFORM PROVIDER MAKES NO REPRESENTATION THAT CONTENT PROVIDED ON OUR MOBILE APP ARE APPLICABLE OR APPROPRIATE FOR USE IN ALL JURISDICTIONS.
You hereby agree to defend, indemnify and hold the Platform Provider harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of our Platform or any products, parts, components and/or services you purchase or avail through it.
This Privacy Policy explains how we work with, collect, use, share and protect information in relation to our Platform and any other service provided on or in connection with our Company (hereinafter collectively referred to as "Services"). Our Privacy Policy is applicable to all visitors, users and any other person (natural or legal) who uses the Services, directly or indirectly, and is meant to be read in accordance with the Terms & Conditions with such respective user (as available on our mobile apps and website).
By using our Services, you understand and acknowledge that you will be providing us with personal data, personally identifiable information and other information through our Platform ("User Content") and provide your consent to us for utilizing the User Content in order to enhance the Services offered to You.
We are committed to ensuring that the User Content shared by You is protected and kept confidential using some of the best data protection and encryption standards.

20.2. Cookies and Internet Tags
A cookie is a small piece of information which is sent to your computer or your mobile phone. Cookies do not cause any damage or harm to your device. You can accordingly set the browser on your electronic device to notify you upon receiving a cookie. This will enable you to decide if you want to accept such a cookie or not. If you do not accept cookies, you may not be able to use all functionality of the Platform or the Services offered by us. We may use and install 'cookies' in order to collect and process information about your use of the Services, such as the site pages you visit, web history and search history. Such information is used by us to help improve the contents of the Platform and the Services and to compile accurate statistics about the usage of our Platform and the Services for internal purposes and for the purpose of enhancing the Services offered to you. We may also use internet tags (also known as action tags, web beacons, single-pixel GIFs, clear GIFs, invisible GIFs and 1-by-1 GIFs) and cookies through the Services and may deploy these tags/cookies through a third-party advertising partner or a web analytical service partner which may be located and may store the respective information (including your IP address) in a foreign country. These tags/cookies may be placed both on online advertisements that bring users to the Services and on different pages of the Platform. Such third-party partner or service partner may be able to collect data about visitors to the Platform and other sites because such internet tags/cookies, may compose reports regarding the website's activity for us and may provide further services which are related to the use of the Site and the internet. They may provide such information to other parties if there is a legal requirement that they do so, or if they hire the other parties to process information on their behalf.
20.3. Mobile Devices
When you download or use the Platform or any other applications created or developed by us (e.g., to deliver the Services), we may receive information about your location and other information about your mobile device, including the unique identifier for your device. We may use this information in order to enhance the Services offered to you and also to provide you with location-based services, such as search results and other personalized content. Most mobile devices allow you to turn off location services and you will be able deactivate this feature, however you will be unable to use all the functionality of the Services.
20.4. Non-Personal Data
